Illinois DUI Law

DUI stands for driving under the influence. This is a criminal offense is outlined in Illinois Vehicle Code 625 ILCS 5, Section 11-501, which states that a person may not operate a motor vehicle:

  • With a blood alcohol concentration at or above .08%;
  • While under the influence of alcohol;
  • While under the influence of any form of controlled substance which renders the person incapable of driving safely; and/or
  • With any amount of illegal controlled substance in the blood or urine.

The Arrest

An officer may make a Lake County DUI arrest if he or she has probable cause to believe that the driver is under the influence of alcohol or a controlled substance. This means that an arrest may be made with or without the confirmation of a breath test or blood test to determine a driver’s blood alcohol concentration. The arresting officer will make observations of the driver’s behavior and may ask to administer field sobriety tests to determine whether a driver is intoxicated.

The Penalties

Simple DUI is a Class A Misdemeanor offense in Illinois. Penalties for a first DUI offense may include: imprisonment for up to 12 months in county jail, fines of up to $2,500, court fees of $500 or more, driver’s license suspension for up to 12 months, community service, and probation.
