DUI Penalties in Lake County, Illinois

Following are the potential penalties that a defendant may face in an Illinois DUI case. The following penalties apply to those offenders with a blood alcohol concentration of .08% to below .16%. or to those who have been determined to be "under the influence" of alcohol or drugs. (Increased penalties will apply to offenders with a blood alcohol level of .16% or greater.) Specific penalties may vary depending upon the particular case and the jurisdiction.

  • First DUI Offense:
    • Class A Misdemeanor
    • 0 to 12 months imprisonment
    • 100 hours of community service
    • 1 year license suspension
    • Fines of up to $2,500
  • Second DUI Offense (within 5 years):
    • Class A Misdemeanor
    • Mandatory 5 days imprisonment or 240 hours of community service
    • Up to 12 months imprisonment
    • Fines of up to $2,500
    • 5 year license suspension
    • Mandatory ignition interlock device (BAIID)
  • Third DUI Offense:
    • Class 2 Felony
    • Mandatory minimum 10 days imprisonment or 480 hours community service
    • 3 to 7 years imprisonment
    • Fines of up to $25,000
    • 10 year driver’s license suspension
    • Mandatory ignition interlock device
  • Fourth DUI Offense:
    • Class 2 Felony
    • 3 to 7 years imprisonment
    • Fines of up to $25,000
    • Permanent driver’s license suspension
  • Fifth DUI Offense:
    • Class 1 Felony
    • 4 to 15 years imprisonment
    • Fines of up to $25,000
    • Lifetime revocation of Illinois driving privileges
